These terms set forth the general conditions of the contract for the services provided by turkishairlinescompensation.com, a platform that connects customers with certified partners specializing in air travel services.

Agreement

Upon signing the authorization document, the customer agrees to the terms and conditions outlined by turkishairlinescompensation.com.

A contract is only established if TurkishAirlinesCompensation agrees to facilitate the customer’s claim through our network of partners. TurkishAirlinesCompensation reserves the right to decline any claim for any reason, and will notify the customer if such a decision is made.

By entering into this agreement, the customer confirms they have the legal authority and capacity to engage in the contract.

The customer assures that the claim has not been transferred to any third parties and that there are no pending or expected legal disputes with any party over the same issue. After the authorization document is signed, the customer cannot engage other parties to manage or assign the claim. Any previous agreements or transfers must be terminated before signing the authorization document.

If the customer receives direct payment or other forms of compensation from the involved airline after the authorization document has been formalized, they must notify TurkishAirlinesCompensation immediately. Such payments are treated as compensation for the incident. Once the authorization document is signed, the customer is required to stop all negotiations with the airline and direct any communications from the airline to TurkishAirlinesCompensation to ensure the best possible outcome.

The contract will terminate:

  • When compensation is successfully negotiated by TurkishAirlinesCompensation, received from the airline, and transferred to the customer, minus any applicable fees.
  • When TurkishAirlinesCompensation determines that it is not feasible to continue the claim and informs the customer that the process will not proceed.

Description of the Service

TurkishAirlinesCompensation will act solely as an intermediary, connecting customers with certified partners who handle both extrajudicial and judicial claims to secure financial compensation.

Customers must submit their flight data and information through the turkishairlinescompensation.com website, email, telephone, or other compatible electronic means. Upon receiving a request, TurkishAirlinesCompensation will assess the viability of the claim.

To effectively process the customer’s claim, TurkishAirlinesCompensation requires an authorization document or mandate, which can be submitted via the website, email, or postal service. Once the authorization is complete, TurkishAirlinesCompensation will coordinate with its partners to lodge a complaint against the airline at the earliest and oversee the entire process.

Our partners strive to negotiate a satisfactory resolution based on their extensive experience. However, if the airline does not respond within a reasonable period, or if the response is unsatisfactory, the matter may be escalated for legal review through one of our partnered legal experts. In such cases, the customer consents to TurkishAirlinesCompensation facilitating the transfer of all relevant data to the independent legal representative handling the case. Should further documentation be needed, such as affidavits or transfer of rights, the customer agrees to sign and incur any associated costs. If our legal partners, whom we connect with the customer, determine that the likelihood of success is minimal, we will inform the customer and no further action will be facilitated through our platform.

If legal proceedings are initiated and subsequently lost, TurkishAirlinesCompensation will absorb all associated costs. Conversely, if the claim is resolved favorably or a settlement is reached, the agreed fees will be charged by TurkishAirlinesCompensation.

The customer empowers TurkishAirlinesCompensation to accept or reject any offers from the airline or its representatives based on our expertise.

Fee and Commission

TurkishAirlinesCompensation provides initial claim facilitation services at no charge. If compensation is successfully secured through our partners, a commission, calculated as a percentage of the compensation amount plus VAT, will be deducted. Additionally, if the customer directly receives compensation from the airline or through legal proceedings, they are required to inform TurkishAirlinesCompensation and settle the agreed-upon fees.

If a customer fails to disclose compensation received, and TurkishAirlinesCompensation has already initiated the claim process, the agreed commission will still be applicable. If a claim is withdrawn due to the customer’s request, duplication of claims, failure to attend necessary proceedings, or negligence, the customer is responsible for the costs incurred up to that point, as specified in our fee schedule.

The legal process is considered initiated when TurkishAirlinesCompensation forwards the claim to our partners. In most instances, formal hearings may not be required; however, if mandated by the air carrier or a court, the customer is expected to either attend or grant legal representation the authority to act on their behalf. If a customer cannot attend, TurkishAirlinesCompensation or its partners may facilitate representation for the client.

In the event of a favorable legal outcome where the airline is required to pay additional charges such as interest and procedural fees, the customer authorizes TurkishAirlinesCompensation to manage these funds. Conversely, if the claim results in financial costs due to an unsuccessful outcome, TurkishAirlinesCompensation ensures the customer is not held responsible for these additional costs.

Customers are obligated to provide accurate and complete information for compensation processing. TurkishAirlinesCompensation reserves the right to deduct any external costs incurred due to inaccurate information from the compensation amount. If the customer fails to respond to communications or provide necessary details after repeated attempts, TurkishAirlinesCompensation retains the right to withhold the portion of the compensation that would have been transferred to the customer.

Once the payment of compensation by the airline or court is made to the customer, TurkishAirlinesCompensation is no longer responsible for any discrepancies in payment delivery due to incorrect customer bank details or addresses, including but not limited to compensation sent to an incorrect recipient. Additionally, no interest will be required for the period between the receipt of payment by the company and its transfer to the customer. TurkishAirlinesCompensation holds the right to retain any interest recovered. Invoices for services and fees can be issued upon request. TurkishAirlinesCompensation is not liable for any delays or failures in transferring compensation due to events beyond its control, such as natural disasters, labor disputes, or legal restrictions.

Data Protection

TurkishAirlinesCompensation commits to using the personal data provided by customers solely for the purpose of facilitating claims, in compliance with EU law, specifically the General Data Protection Regulation (GDPR) of 27 April 2016. This regulation governs the protection of natural persons with regard to the processing of personal data and the free movement of such data. By engaging with our services, the customer explicitly consents to TurkishAirlinesCompensation processing their data for these purposes.

TurkishAirlinesCompensation will transfer personal data to third parties only under the following conditions:

  • When it is directly related to the initial purpose for which the data was collected, such as facilitating a claim with our partners.
  • When necessary for the preparation, negotiation, and execution of a contract with the client, ensuring the effective handling of the claim.
  • If required by legal, administrative, or judicial obligations, ensuring compliance with applicable laws and regulations.
  • When it is necessary for the verification or protection of a legal right in judicial proceedings, supporting the client’s claim through legal channels if needed.

Customer Information and Data

Customers must provide all necessary data and information accurately and completely for TurkishAirlinesCompensation to facilitate their claims effectively. Customers agree to indemnify TurkishAirlinesCompensation against any third-party claims arising from inaccuracies, incomplete information, or fraudulent behavior.

Should the information provided be incorrect or fraudulent, TurkishAirlinesCompensation reserves the right to terminate the contract immediately. In such cases, the customer will forfeit any right to compensation. All documentation related to the management of the claim, whether handled outside of or within the court, remains the property of TurkishAirlinesCompensation. However, TurkishAirlinesCompensation retains the right to furnish such documents to the customer upon request. Customers will be regularly updated on the status of their claims upon request.

Withdrawal Policy

Customers have a 14-day period from the date of agreement to withdraw from the contract without any cost. To exercise this right, customers must provide a clear and unequivocal statement of their desire to cancel the claim, directed via email to [email protected]. Withdrawal is not permitted once the claim has been accepted by the service provider, as the service deemed completed by such acceptance.

Final Provisions

TurkishAirlinesCompensation reserves the right to modify these Terms and Conditions, fees, and introduce additional terms at any time without prior notice. However, changes that negatively affect our clients will only be applied with the client’s consent. These Terms and Conditions, along with the authorization document and the client agreements, are governed by applicable laws.

Any disputes arising under these terms will be resolved through judicial proceedings. This ensures that all parties have a clear understanding of the legal framework within which TurkishAirlinesCompensation operates and provides a basis for the resolution of any potential disputes.
